This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in G.R. Case No.40 of 2021, on the files of learned Additional District Judge-cum-Special Court under POCSO Act, Berhampur, Ganjam, arising out of Rambha P.S. Case No.67 of 2021, under Sections 450/376(2)(n)(f)/506/34 of IPC read with Section 6 of POCSO Act and is in custody since 27.02.2021.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional District Judge-cumSpecial Judge under POCSO Act, Berhampur, by order dated
13.05.2021 in the aforementioned case, the present BLAPL has been filed.

Considering the tenor of the statement recorded under Section 164 Cr.P.C. and taking into account the period of custody of petitioner, this Court directs him to be released on bail on such terms to be fixed by the Court in seisin of the matter. 6.
Accordingly, the BLAPL stands disposed of.

Urgent certified copy of this order be granted as per rules.
