This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard learned counsel for the petitioner and learned counsel for the State.
The limited grievance of the petitioner in this writ petition is for a direction to opposite party no.2 to accept the bid validity of the petitioner till 02.06.2022 in Annexure-8 with additional performance security or in alternative allow the petitioner to participate in the lottery along with other seven bidders as per letter dated 24.05.2022 in Annexure-7 for the work improvement of road from Sounthmunda to Kalijharan under MMSY (RIDF) for the year 2021-22 in tender call notice No.BLGR online-18/2021-22 of C.C.E.R.W. Circle,

Learned counsel for the petitioner submitted that he has filed a representation before the Chief Engineer (Plan Roads), Rural Works(O)- opposite party no.2 for extension of Bid Validity for drawal of Agreement for the tender work Improvement of road from Sounthmunda to Kalijharan road under MMSY for the year 2021-22 under Annexure-8, but no decision has yet been taken and the same may be considered at an earliest. Learned counsel for the State has no objection to the prayer made in such application.
Considering the submissions made by the learned counsel for the respective parties, the Chief Engineer (Plan Roads)- opposite party no.2 shall do well to dispose of the representation filed by the petitioner under Annexure-8 within a period of four weeks from today after giving an opportunity of hearing to the petitioner.
With the aforesaid observation, this writ petition is disposed of.
Issue urgent certified copy as per Rules.
