1. This matter is taken up through hybrid mode. Order No.

2. The petitioner is aggrieved by disconnection of the power supply by the opposite party-TPCODL under the opposite party no.1-Executive Engineer, BCDD, Bhubaneswar Division-II, TPCODL, Nayapalli, Bhubaneswar.

It is submitted by the learned counsel for the petitioner that the disconnection of the electricity supply was consequence of a provisional assessment on 28.05.2022 and non-payment of the dues assessed by the said provisional assessment for the period 28.05.2021 to 27.05.2022 (Annexure-2) on the allegation of meter tampering.

4. It is further submitted by the learned counsel for the petitioner that the list of installed electrical equipments in the premises of the petitioner, i.e., the connected load as indicated in Annexure-3 may be correct, but since the same are not being used, the actual consumption is less.

5. It is further submitted that the petitioner may be permitted to move the appropriate authority of TPCODL for getting reconnection.

6. In view of the above submissions, it is directed that the authority shall take a decision on the request/representation of the petitioner as expeditiously as possible preferably within a period of seven working days considering the fact that the petitioner is going without any electricity in sweltering heat and suffering immensely.

7. The petitioner shall have the liberty to offer an amount that he would pay to the TPCODL, the authority shall take a decision on the same, taking into consideration the fact that TPCODL has the monopoly in supply of electricity to a consumer like the petitioner.

8. It is clarified that this Court has not expressed any opinion on the merits of the case, in any manner whatsoever.

9. The writ petition is disposed of accordingly.
