Heard learned counsel for the parties.

The Petitioner is an accused in connection with C.T. Case No. 45 of 2022 arising out of Dharmasala P.S. Case No. 11 of 2022 pending on the file of learned JMFC, Chandikhol, for the alleged commission of offence under Sections 498-A/302/506/34 of the I.P.C.

Being aggrieved by the rejection of his application for bail U/s 439 Cr.P.C. by the learned Sessions Judge, Jajpur by order dated 20.05.2022, the present BLAPL has been filed 5.

It is seen that though in the case at hand F.I.R. was filed inter alia, under Sec. 302 of the I.P.C., after investigation Charge Sheet has been submitted under Sections 498A/304(B)/306/201/511 of the I.P.C. read with Section 4 of the D.P.Act.

Taking into account the accusation and filing of Charge Sheet under Section 306 of the I.P.C. and considering the materials on record relating to the death of the victim and the period of custody, this Court directs the petitioner to be released on bail on such terms to be fixed by the court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
