This matter is taken up through Hybrid arrangement (video conferencing/physical mode).
The grievance of the Petitioner in this writ application is with regard to refund of certain amount from the Tahasildar, Tangarapali in the district of Sundargarh in respect of lease of Abankela Sand Bed.
Mr. Mishra, learned counsel for the Petitioner submits that in that regard, he has made a representation to Tahsildar, Tangarapali (Opposite Party No.3) on 25th November, 2021 at Annexure-3 but no decision has yet been taken. He, therefore, prays for direction for early disposal of the representation and to refund the amount mentioned therein at an early date.
// 2 // Ms. Pattnaik, learned Addl. Govt. Advocate submits that she has no instruction in the matter. However, if the representation is still pending with the Opposite Party No.3, a decision on the same may be taken at an early in accordance with law.
Taking into consideration the submission made by the learned counsel for the Parties, this Court without expressing any opinion on the merits of the case of the Petitioner, disposes of the writ petition with a direction that on production of the certified copy of this order within a period of two weeks hence, the Tahasildar, Tangarapali shall do well to take a decision on the representation dated 25th November, 2021 at Annexure-3 in accordance with law as expeditiously as possible, preferably, within a period of three months therefrom, if the same is still pending. Issue urgent certified copy as per rules.
