Heard learned counsel for the petitioners and learned counsel for the State.
This is an application under section 438 Cr.P.C. for grant of anticipatory bail to the petitioners in connection with Puruna Bazar P.S. Case No.108 of 2022 corresponding to G.R. Case No.1228 of 2022 pending in the Court of learned S.D.J.M., Bhadrak for alleged commission of offences under sections 341/323/307/376/506/34 of the Indian Penal Code. Perused the FIR annexed to the anticipatory bail application.
// 2 // Learned counsel for the petitioners submitted that the main allegation is against Mir.Mairaj, who is the father of the petitioners and in view of the nature of accusation against the petitioners, the anticipatory bail application may be favourably considered.
Learned counsel for the State opposed the prayer for anticipatory bail.
Considering the nature and gravity of accusation, while not inclining to grant anticipatory bail to the petitioners, I direct that in the event the petitioners surrender and move for bail before the learned Court below, the same shall be disposed of expeditiously by the learned Courts below in accordance with law. The case records shall be made available to the Courts concerned.
The ABLAPL is accordingly disposed of.
Urgent certified copy of this order be granted on proper application.
