This matter is taken up through Hybrid Mode.

Heard learned counsel for the petitioner and learned counsel for the State.

Learned counsel for the petitioner states that the chargesheet has been filed under Section-498(A)/306 of the I.P.C in connection with S.T. Case No.05/69 of 2020-21, arising out of Pandapada P.S. Case No. 85 of 2020 on the file of learned Assistant Sessions Judge (STC), Keonjhar and the petitioner is in custody since 05.08.2020.

Learned counsel for the State referring to the statements on record states that there is patent material to indicate that the deceased was subjected to torture which drove her to commit suicide.

On a conspectus of materials on record and taking into account the period of detention and taking note of the submission

of the learned counsel for the petitioner that the trial has not commenced. This Court is of the considered opinion that, further detention of the petitioner in the factual matrix of the present case is not warranted. Hence, it is directed that the petitioner shall be released on bail. Terms to be fixed by the learned Court in seisin of the matter.

The BLAPL is disposed of accordingly.
