Heard Mr. S.K.Baral, learned counsel for the petitioner and Mr.D.Nayak, learned Additional Government Advocate.

In this case prayer has been made for a direction to opposite party Nos. 4 to 5 to execute the N.B.W. and for arrest of accused persons in connection with I.C.C. Case No. 448 of 2018 pending in the Court of learned S.D.J.M., (Sadar), Cuttack.

In course of hearing Mr.Baral submits that liberty may be granted to the petitioner to approach the learned S.D.J.M.(Sadar), Cuttack under Sections 82 and 83 of the Cr.P.C.

Considering the submissions made and without expressing any opinion on the merits of the case, this Court grants liberty to the petitioner to move application/s before the learned S.D.J.M.(Sadar), Cuttack under the appropriate

// 2 // provisions of the Cr.P.C. within a period of two weeks from today. In the event, such application/s is/are filed, the learned S.D.J.M.(Sadar), Cuttack is directed to proceed with the same in accordance with law, if there is no other impediment.

Accordingly, the CRLMP is disposed of.

Urgent certified copy of the order be granted on proper application.
