This matter is taken up through hybrid mode.

The State-petitioners have filed this writ petition challenging the order dated 02.12.2013 passed in O.A. No. 31 (B) of 2013, by which the Odisha Administrative Tribunal, Bhubaneswar taking into consideration the order passed by this Court in W.P.(C) No. 21894 of 2010, disposed of the original application with a direction to the State-opposite parties threin to protect the pay of the opposite party as per the provisions of the Orissa Service Code and Finance Department Office Memorandum dated 04.12.1999, from the date of his joining in government service in the year 1999 and to draw and disburse the differential salary to him within a period of three months from the date of receipt of copy of the order.

Though the tribunal passed the order impugned on 02.12.2013, but the State-petitioners have approached this Court by filing the present writ petition only on 08.10.2015, i.e., after long lapse of near about one and half years. Thereby, this writ petition is suffers from delay and laches, in view of the judgment/order of this Court in the case of State of Odisha v. Surama

Manjari Das (W.P.(C) No. 15763 of 2021 dismissed on 16.07.2021). 4.

In the above view of the matter, this Court is not inclined to go into the merits of the case itself. Accordingly, the writ petition stands dismissed.
