This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

Name of Mr. J.K. Khuntia and Mr. H.S. Deo be deleted since the brief has been transferred and learned counsel Mr. J.K. Majhi has entered appearance.

The petitioner is an accused in 2(a) CC Case No.25 of 2021 (N) arising out of P.R. No.13 of 2021-22 dated 12.04.2021, pending on the files of learned Sessions Judge-cum-Special Judge, Ganjam, Berhampur, under Sections 20(b)(ii)(C) of the NDPS Act and is in custody since 12.04.2021.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Sessions Judge-cum-Special Judge, Ganjam, Berhampur, by order dated 22.04.2021 in the aforementioned case, the present BLAPL has been filed.

Taking into account the quantity of contraband of seizure being 150 kgs, this Court is not inclined to entertain this application in view of the bar contend under Section 37 of the NDPS Act. The BLAPL application accordingly stands rejected. 7.

It is open to the petitioner to move the learned Session Judge-cum-Special Judge for expediting the trial. 8.

Accordingly, the BLAPL stands disposed of.
