This matter is taken up through hybrid arrangement (virtual/physical mode).

Heard learned counsel for the Petitioner as well as learned counsel for the State.

The Writ Petition has been filed by the Petitioner with the following prayer:

"In the facts and circumstances, the petitioner humbly prays that this Hon'ble Court may graciously be pleased enough to issue the writ or direction or orders in the nature of mandamus or any other appropriate writ to fixation of inter se seniority promotion o the deceased husband of petitioner namely Hemanta Kumar Mohanty who was working in the Office of the Opp. Party No.3 and sanction all the consequential service benefits retrospectively and family pension to her."

4. Learned counsel for the Petitioner confines his prayer to the final benefits that is due and admissible to the Petitioner. He further submits that he has submitted a representation before the Director, Higher Education, Odisha, Bhubaneswar, Opposite Party No.2, dated

// 2 // 07.09.2021 under Annexure-5 , which according to the Petitioner is pending before the Authority for consideration.

Considering the limited nature of grievance and considering the facts and circumstances of the case, this Court directs the Director, Higher Education, Odisha, Bhubaneswar, Opposite Party No.2 to consider the representation of the Petitioner dated 07.09.2021 (Annexure-5) within a period of two months from the date of receipt of certified copy of this order, strictly in accordance with law by passing a speaking and reasoned order. Decision so taken be communicated to the Petitioner within a period of two weeks thereafter.

6. With the above direction, the Writ Petition stands disposed of.
