The Petitioner in this petition has challenged the order dated 25th April, 2007 passed by the learned Executive Magistrate, Jharsuguda in CMC No.407 of 2004 under Annexure-1.

Learned counsel for the Petitioner submits that he has no instruction in the matter from his client.

Considering the submission of the learned counsel for the Petitioner and the fact that the case is the year 2007, this Court is of the view that the Petitioner is a recalcitrant litigant and does not want to proceed with the matter.

Hence, this CRLMC stands dismissed for non-prosecution. (S. Pujahari) Judge DA
