This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

Heard learned counsel for the Petitioner and learned counsel for the State.

This writ petition has been filed by the Petitioner with the following relief:

"Under the aforesaid facts and circumstances, it is therefore, prayed that this Hon'ble Court may graciously be pleased to direct the Opp. Parties to regularize the services of the petitioner as ICDS Lady Supervisor under Dangadi ICDS Project after completion of 10 years of service as per G.A. Deptt. Resolution dt.17.09.2013 and as per law laid down by Apex Court in case of State of Karnataka Vrs. Umadevi (3) reported in (2006) 4 SCC 1, State of Karnataka Vrs. M.L. Keshari, reported in (2010) 9 SCC 247 as well as the recent decision dtd.09.09.2021 of this Hon'ble Court in W.P.(C) No.19951 of 2020 alternative;

Or pass such other order/orders as this Hon'ble Court may

// 2 // deem fit and proper in the facts and circumstances of the case. And for this act of kindness, the Petitioner as in duty bound shall ever pray."

Learned counsel for the Petitioner submits that ventilating his grievance, Petitioner has filed a representation before the Collector, Jajpur, Opposite Party No.3, dated 24.02.2022 under Annexure-8, which according to the Petitioner is pending for consideration. It is further submitted that the issue involved in this case is analogous to one involved in W.P.(C) No.19951 of 2020, which has been allowed on 09.09.2021.

Considering the limited nature of grievance and considering the facts and circumstances of the case, this Court directs the Collector, Jajpur, Opposite Party No.3 to consider the representation of the Petitioner dated 24.02.2022 (Annexure-8) taking into consideration Annexures-5 and 6 and the fact that this Court has allowed the selfsame prayer made in W.P.(C) No.19951 of 2020 on 09.09.2021, within a period of two months from the date of receipt of certified copy of this order, strictly in accordance with law, by passing a speaking and reasoned order. Decision so taken be communicated to the Petitioner within a period of two weeks thereafter.
