This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in C.T. Spl.(POCSO) Case No.48 of 2022, on the files of learned Additional sessions Judgecum-Special Judge, Jajpur, arising out of Kalinga Nagar P.S. Case No.48 of 2022, offences under Sections 363/ 366/ 120(B)/ 376(2)(n)/ 34 of IPC and is in custody since 28.04.2022. 4.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge-cumSpecial Judge, Jajpur, by order dated 25.05.2022 in the aforementioned case, the present BLAPL has been filed. 5.

Learned counsel for the petitioner submits that charge sheet in the case at hand has been filed on 20.07.2022 hence further

continuance of the petitioner is unwarranted, as he is in custody since 28.04.2022.

Perused the 164 statement produced by the learned counsel for the State and considering the tenor of such statement and the medical examination report which is on record, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
