Petitioner in this RPFAM seeks to assail the ex-parte judgment and order dated 26th April, 2022 passed by the learned Judge, Family Court, Cuttack in Cr.P. No.58 of 2020. 3.

Since the Petitioner has remedy under proviso to Section 126 (2) of Cr.P.C., I am not inclined to entertain this RPFAM. However, this order shall not preclude the Petitioner to avail the remedy under proviso to Section 126(2) of Cr.P.C. 4.

The RPFAM is accordingly disposed of.
