This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in G.R. Case No.168-A of 2012, pending on the files of learned J.M.F.C., Laxmipur, arising out of Narayapatna P.S. Case No.34 of 2012, under Sections 121/121(A) of IPC read with Section 4 and 5 of E.S. Act read with Section 17 of Crl.L.A. Act.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional District and Sessions Judge-cum-Special Judge, Koraput, by order dated 05.04.2021 in the aforementioned case, the present BLAPL has been filed. 5.
Taking into account the judgment acquitted in respect of the co-accused in dated 27.08.2016 by the Additional Sessions Judge, Koraput in Criminal Trial No.89 of 2014 and the nature of accusation, and considering the period in custody, this Court directs that the
petitioner shall be released on bail on such terms to be fixed by the court in seisin of the matter, so as to ensure his presence on each date of trial.

Accordingly, the BLAPL stands disposed of.
