This matter is taken up through Hybrid Mode.

The petitioner is an accused in connection with T.R. Case No. 344 of 2020 arising out of Tentulikhunti P.S. Case No. 163 of 2020, pending on the file of the learned Additional Sessions Judge-cum-Special Court under POCSO Act, Nabarangpur for the alleged commission of offence under Sections363/366/376(2)(n)/376(3)/294/323/506 of the IPC read with Section-6 of the POCSO Act & Sections 3(1)(r)/3(1)(s)/3(2)(v)(va) of the S.C & S.T. (POA) Act. The petitioner is in custody since 27.11.2020.

Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C. by the learned Addl. District & Sessions Judge-cum-Special Court under POCSO Act, Nabarangpur by
Order dtd. 09.03.2021 in T.R. Case No. 344 of 2020, the present BLAPL has been filed.

Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

Learned counsel for the State on instruction submits that notice has been served on the informant pursuant to the direction of this Court dtd. 22.07.2021.

There is no appearance on behalf of the informant at the time of call.

Perused the 164 Cr.P.C statement of the victim and taking into account the tenor of such statement. And, being cognizant of the factum of filing of charge sheet and the petitioner being in custody since 27.11.2020, this Court directs the petitioner shall be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

The Bail Application thus stands disposed of. 9.
