Mr. Panda, learned advocate appears on behalf of petitioner and submits, impugned is ex-parte order dated 12th May, 2022, passed by opposite party no.3. His client wants the order be set aside so that the matter is restored and his client can be heard. 2.

Mr. Mohapatra, learned advocate appears on behalf of opposite party no.2 and submits, a date to be fixed for hearing by the appellate authority. Mr. Nanda, learned advocate, Additional Government Advocate appears on behalf of State.

Considering that the corporation is willing to contest on merits before the appellate authority, impugned order dated 12th May, 2022 is set aside and quashed, simply because it is ex-parte. 4.

Petitioner is directed to produce this order before opposite party no.3 for purpose of re-hearing on restoration of the matter. Said opposite party is requested to notice the parties, fix early date of hearing and deal with the case. It is made clear, in event petitioner thereafter goes unrepresented, opposite party no.3 may reiterate its earlier order.

The writ petition is disposed of.
