Petitioner in this RPFAM seeks to assail the order dated 28th February, 2010 (Annexure-1) passed by learned Judge, Family Court, Cuttack in Cr.P. No.803 of 2008. 3.

Learned counsel for the Petitioner prays for an adjournment.

On perusal of order sheet, it appears that the Petitioner, vide order dated 16th May, 2011, was directed to remove the defect. But the defect has not yet been removed. In this RPFAM Petitioner seeks for enhancement of the maintenance amount directed to be paid to her. Since eleven years have already elapsed from the date of filing of the RPFAM and the Petitioner has not taken any step for removal of the defect in spite of direction of this Court, I am not inclined to adjourn the matter, as prayed for.

Accordingly, the RPFAM is disposed of with an observation that the Petitioner, if so advised, may move the appropriate Court of law for enhancement of the maintenance amount.
