1. There is a delay of 142 days in filing the present appeal against an award dated 8th March 2007, passed by the 2nd MACT, Northern Division, Sambalpur in Misc. (J) Case No.87 of 1993. The reason given for condonation of delay is only administrative or technical i.e., delay in getting certified copy, delay in processing the file in the Divisional Office and so on. These kinds of reasons for the delay are not convincing at all. In a recent series of judgments, the Supreme Court has insisted that the reasons for delay have to be convincing and appropriate.
2. Consequently, the Court is not satisfied that there is any bona fide reason for the delay of 142 days of filing the present appeal. The delay is accordingly not condoned. The present Misc. Case is accordingly dismissed. Consequently, the appeal is dismissed. (Dr. S. Muralidhar) Chief Justice S.K. Guin
