Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner Sukadev Badhai has filed this writ petition challenging the tender call notice of the Tahasildar, Tangarpali (opposite party No.3) for sand quarry lease dated 19.05.2022 vide Annexure-3. It is stated in the writ petition that the villagers of Bileigarh are residing both the side of village road and due to running of heavy vehicles through the village road, the road has been damaged so also the lives of the children are in danger.
Learned counsel for the petitioner submitted that the
// 2 // petitioner may be given an opportunity to file a detailed representation before the Collector, Sundargarh (opposite party no.2) highlighting the stands taken in the writ petition and the same may be considered giving an opportunity of hearing to the petitioner.
Learned counsel for the State has no objection to the submission made.
Considering the submissions made by the learned counsel for the respective parties and without expressing any opinion on the merits of the case, the writ petition is disposed of directing the petitioner to file a representation before the opposite party no.2- The Collector, Sundargarh within a period of two weeks from today. In case such a representation is filed, the opposite party no.2 shall consider the same within a period four weeks from the date of submission of the representation after giving an opportunity of hearing to the petitioner and communicate the result of such exercise to the petitioner. Urgent certified copy of this order be granted on proper application.
