The petitioner has filed this writ petition seeking direction to opposite parties to grant scale of pay of Rs.16402900/- w.e.f. the date the strength of S.B. Women's College exceeded 2000, and the scale of pay of Rs.2000-3500/- in the post of Senior Librarian w.e.f. 10.09.1997 the date from which the Librarian of other lead colleges got the scale, as she is entitled to get Rs.6500-10500/- as per revision of pay scale Rules, 1996 which came into force w.e.f. 01.01.1996. She further seeks direction to the opposite parties to re-fix her pay as per revised scales of pay Rules with all financial and service benefits retrospectively.

Counter affidavit filed by opposite party no.3 wherein in paragraph-8 it has been specifically mentioned that representation of the petitioner has been duly forwarded to the

competent authority/Government recommending up-gradation of the post of Librarian vide letter dated 20.12.1997 and 29.01.1998 which has been annexed as Annexure-C. But no action has been taken by the Government till date. Therefore, the petitioner approached the tribunal by filing O.A. No.3572 (C) of 2000 which was disposed of vide order dated 06.04.2001 directing the authority to consider the grievance of the petitioner. In compliance of the said order, vide AnnexureC dated 04.12.2001, the original service book of the petitioner was sent to the Government for further action. Thereafter, the representation of the petitioner has been forwarded by the college authority to the Government for up-gradation of the post of Librarian, but till date no action has been taken. 4.

In the above view of the matter, this writ petition stands disposed of directing opposite party no.1 to take necessary steps with regard to the recommendation made by the college authority for up-gradation of the post of Librarian for grant of benefit as due and admissible to her and pass appropriate order in accordance with law within a period of three months from the date of production of certified copy of this order.
