The Petitioner in this writ petition seeks for a direction for early disposal of G.P. Election Misc. Case No.29 of 2022 stated to be pending before the Collector, Puri.

Mr. Patra, learned counsel for the Petitioner submits that assailing the election of Opposite Party No.2, namely, Banamali Rout, as Sarpanch of Dochhian Gram Panchayat, the Petitioner has filed an election dispute in G.P. Election Misc. Case No.29 of 2022. Although all the parties to the election misc. case have already entered appearance, but the matter is being delayed for non-filing of show cause by Opposite Party No.2 to the said Election Misc. Case. He further submits that the authority must make an endeavour to dispose of the Election Misc. Case at an early date. As such, a direction may be made for early disposal of G.P. Election Misc. Case No.29 of 2022 pending before the Collector, Puri.

Mr. Pattnaik, learned Additional Government Advocate submits that the submission made by learned counsel for the

// 2 // Petitioner clearly discloses that the matter is not ready for hearing. Hence, no direction for early disposal of the election misc. case should be made at this stage.

Taking into consideration the submissions made by learned counsel for the parties, this Court is of the considered opinion that since G.P. Election Misc. Case No.29 of 2022 is not ready for hearing, no direction for early disposal of the same can be issued at this stage. However, the Petitioner, if so advised, may file an application before the Collector, Puri-Opposite Party No.1 for early disposal of G.P. Election Misc. Case No.29 of 2022 stating the grounds therein after the matter becomes ready for hearing. 6.

With the aforesaid observation, this writ petition is disposed of.

Urgent certified copy of this order be granted on proper application.
