This is an application under Section 439 of Cr.P.C. for releasing the petitioner-Basanta Samal on bail, who is facing trial in S.T. Case No. 10 of 2021 (which arises out of Nemalo P.S. Case No. 02 of 2021) corresponds to G.R. Case No. 02 of 2021 in the Court of the learned Additional Sessions Judge, Salepur, for commission of offences punishable under Sections 363/376/506/114 & 34 of IPC.

The earlier bail application of the petitioner i.e. BLAPL No. 2665 of 2021 had been dismissed vide order dated 27.04.2021. 4.

Memo has been filed by the learned counsel for the petitioner stating that the petitioner may be permitted to withdraw the bail application. 5.

Considering the above mentioned memo, the BLAPL is dismissed as withdrawn.
