Heard learned counsel for the parties.
This Writ Petition has been filed with the following prayer:
"The petitioner, therefore, most respectfully pray that the Hon'ble Court may graciously be pleased to issue notice to the opposite parties and after hearing to the parties to this writ petition, this Hon'ble Court may further be pleased to issue a writ in the nature of mandamus or any other appropriate writ/writs by directing the opposite parties not to take physical possession of the petitioner's land appertaining to Sabik Khata No.139, Plot No.732, measuring an area Ac. 0.40 decimals corresponding to Hal Khata No.134, Plot
// 2 // No.1853, Area Ac. 0.40 decimals under Mouza-Bhuban Natakata Unit-4, P.S./TahasilBhuban, Dist-Dhenkanal without releasing compensation in favour of the petitioner under the provisions of the Act for the ends of justice;
And/or pass any such order/orders and directions as may be deemed just and proper in favour of the petitioner and allow the writ petition;
And for which act of kindness, the petitioner shall as in duty bound, ever pray." Taking into account the nature of claim made in the Writ Petition and the prayer made by the learned counsel for the Petitioner, the Petitioner is permitted to make a fresh representation before Opp. Party No.1 - Zone Officer -cum- Land Acquisition Officer, Rengali Irrigation Project, At/PO/PS-Sukinda, DistJajpur within a period of (15) fifteen days from today. It is observed that if such a representation is filed by the Petitioner ventilating his grievances, the same shall be considered by Opp. party No.1 in accordance with law within a period of the three months from the date of filing of such representation after giving opportunity of hearing to the petitioner and communicate the result of such exercise to the petitioner.
With the aforesaid observation and direction, the Writ Petition is disposed of.
