Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 11.05.2022 in connection with Banarpal P.S. Case No.101 of 2003 corresponding to C.T. Case No.1942 of 2003 pending in the Court of learned J.M.F.C., Banarpal for the alleged commission of offence under Section 47-A of Bihar and Orissa Excise Act. 4.
The petitioner was originally on police bail and after submission of charge sheet because of his non-appearance, NBW was issued vide order dated 26.09.2016 by learned Court below.

It is submitted that his non-appearance was due to communication gap between him and his lawyer and that he is ready and willing to appear before the Court henceforth on each date of posting of the case.

Considering the submissions as above as also the fact that the petitioner was earlier on bail, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such
terms and conditions as the Court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case without fail.

BLAPL is accordingly disposed of.
