Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The Petitioner is in custody since 13th August, 2021 in connection with Sahidnagar P.S. Case No.315 of 2021 corresponding to T.R. No.349 of 2021 pending in the Court of learned District and Sessions Judge, Khurda for the alleged commission of offence under Sections 21(c)/29 of NDPS Act. 4.

The allegation is that the petitioner and some other persons were in possession of brown sugar weighing 260 grams when they were apprehended. As it appears, there was separate seizure from four persons including the present petitioner and at separate time intervals. In so far as the present petitioner is concerned, brown sugar weighing 70 grams was recovered from his possession.

5. Considering the above facts and taking into account the period of detention of the petitioner in custody, I am inclined to

allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case without fail. 5.

BLAPL is accordingly disposed of.
