This matter is taken up through hybrid mode.

This CMP has been filed assailing the order dated 16th May, 2018 (Annexure-5) passed by learned Civil Judge (Junior Division), 2nd Court, Cuttack in C.S. No.422 of 2004, whereby an application filed by the Petitioners under Order XXVI Rule 9 C.P.C. has been rejected.

Mr. Pradhan, learned counsel for the Petitioners by filing a memo dated 28th March, 2022 (Flag-K) submits that since the suit has already been disposed of vide judgment dated 11th March, 2022, this CMP has become infructuous. Hence, he prays for withdrawal of the CMP.

In view of the above, this CMP stands disposed of as withdrawn.
