Heard learned counsel for the petitioner as well as learned Addl. Government Advocate for the State of Odisha.
This Writ Petition which is in the nature of Public Interest Litigation has been filed by the petitioner with a prayer to direct the opposite parties not to damage/cut the PWD Road of village of Jarada and not to evict the displaced families of Jarada without resettling them in the proposed resettlement site.
Learned counsel for the petitioner submitted that highlighting the grievances of village committee of Jarada the petitioner has filed a representation on 24.05.2022
// 2 // before the Collector, Angul, which is not considered. However, he submitted that the petitioner will file a fresh representation before the opposite party no.3 General Manager, Mahanadi Coalfield Ltd. in the light of the stand of the writ petition within a week and the same may be directed to be disposed of at an earliest giving opportunity of hearing to the petitioner.
Considering the limited nature of grievance raised by the petitioner, the writ petition is disposed of directing the petitioner to file a fresh representation before the opposite party no.3 General Manager, Mahanadi Coalfield Ltd. within a period of one week. In case such a representation is filed, the opposite party no.3 shall consider the same within a period two weeks from the date of submission of the representation after giving an opportunity of hearing to the petitioner and communicate the result of such exercise to the petitioner. It is made clear that till a decision is taken, no coercive action shall be taken against the petitioner. If the petitioner does not file any representation within the stipulated period, the Authority shall proceed with the matter.
Urgent certified copy of this order be granted on proper application.
