Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 14th August, 2021 in connection with Harichandanpur P.S. Case No.98/2021 corresponding to S.T. Case No.86/2021 pending in the court of learned Sessions Judge, Keonjhar for the alleged commission of the offence under Sections 302/201/342/34 of I.P.C. 4.

It is alleged that the petitioner and another person assaulted the deceased thereby causing his death. As it appears except for so called confessional statement of the co-accused and the extra judicial confession of the said co-accused before his wife, there is no other acceptable material on record to show the involvement of the petitioner in the alleged occurrence.

Considering the above facts and taking into consideration the period of detention of the petitioner in custody, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as may be

imposed by the court in seisin over the matter in the aforesaid case including the condition that he shall appear before the court below on each date of posting of the case without fail. 6.

BLAPL is accordingly disposed of.
