This matter is taken up through Hybrid arrangement (video conferencing/physical mode).

Heard learned counsel for the petitioner and learned counsel for the State.

This Writ Petition has been filed by the petitioner with a prayer for disposal of the representation of the petitioner dated 21.05.2022 under Annexure-9 series for extension of time up to March, 2023 to complete the balance work i.e. Construction of H.L. Bridge over River Devi at 16th km on Haladiapada-Govindpur in the district of Cuttack as per clause 3.5.30 of OPWD Code. Learned counsel for the petitioner submitted that the said representation has not yet been considered and the concerned authority may be directed to consider the same

// 2 // after giving an opportunity of hearing to the petitioner. Learned counsel for the State has no objection to the prayer made in the writ petition regarding disposal of representation.

Considering the submissions made by the learned counsel for the respective parties and in view of the limited nature of grievance of the petitioner, the writ petition is disposed of directing the opposite party no.1 Principal Secretary, Rural Development Department to consider the representation dated 21.05.2022 of the petitioner as per Annexure-9 series and dispose of the same within a period of two weeks from today after giving an opportunity of hearing to the petitioner and communicate the result of such exercise to the petitioner. Till then, no coercive action shall be taken against the petitioner.

The opposite party no.1 shall act upon the certified copy of the order produced before him with the copy of the writ petition.

Urgent certified copy of this order be granted on proper application.
