Mr. Mohapatra, learned advocate appears on behalf of petitioner. He submits, the bank (opposite party no.3) though had received the subsidy, failed to disburse same to his client. 2.
Mr. Pattnaik, learned advocate, Additional Standing Counsel appears on behalf of State but the bank goes unrepresented inspite of good service.

There is presumption that the bank cannot resist claim of petitioner, for disbursement of the subsidy. It appears, petitioner's grievance is genuine.

Opposite party no.3 is directed to release subsidy amount of Rs.10,50,000/- by crediting loan account of petitioner, thereupon will calculate outstanding on adjustment of the subsidy amount as per sanction order, calculate amount repayable by petitioner and inform same to him within three weeks of communication. 5.
The writ petition is disposed of.
