This matter is taken up through hybrid mode.

Heard Mr. B.K. Routray, learned Counsel for the Petitioner and Mr. P.P. Mohanty, learned Addl. Government Advocate appearing for the State-Opposite Parties.

The Petitioner has filed this Writ Petition seeking to exonerate it from the penalty of Rs.2,35,500/- imposed on it vide Annexure-5, and further seeks to quash the Order dated 17.03.2022 passed by Opposite Party No.2 under Annexure-1. 4.

Since the matter is arising out of a contract, this Court is not inclined to entertain this Writ Petition. However, liberty is granted to the Petitioner to pursue its remedy before the appropriate forum in terms of the DTCN/Agreement, which is applicable to it, or approach the competent Civil Court claiming such benefit. 5.

With the aforesaid liberty, the Writ Petition stands disposed of.
