This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner and learned Addl. Standing Counsel for the State.

This is an application under Section 438, Cr.P.C. filed by the Petitioner for anticipatory bail, involving offence punishable under Sections 420/272/273/34, I.P.C. & Sections 51/52/53/56/57/59/63 of Food Safety and Standard Act, read with Section 102/103 of Trade Mark Act, read with Section 32 of Legal Meteorology Packaging of Commodities Rule, 2011.

It is submitted by learned counsel for the Petitioner that the Petitioner is the mother of the principal accused namely Ajay Das, who has already been released on bail by this Court vide order dated 24.06.2022 passed in ABLAPL No.2153 of 2022. He further submits that the Petitioner is an old and ailing lady aged about 78 years.

Considering the aforesaid submissions, nature the allegation, and the facts of the case and particularly considering the old age of the Petitioner, it is directed that, in the event of arrest in connection with Bentakar (42 Mouza) P.S. Case No.27 of 2022 corresponding to G.R. Case No.424 of 2022 pending in the Court of learned J.M.F.C. (R), Cuttack, the Petitioner shall be released on bail by the Arresting Officer on such terms and conditions as the Arresting Officer shall deem just and proper in the facts and circumstances of the case. 6.
The ABLAPL is disposed of accordingly.
