This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in G.R. Case No.02 of 2021, on the files of learned Special Judge-cum-Additional Sessions Judge, Gajpati at Paralakhemundi, arising out of R.Udayagiri P.S. Case No.11 of 2021, under Sections 376 (2)(n)/506 of IPC read with Section 6 of the POCSO Act and is in custody since 15.01.2021.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Special Judge-cum-Additional Sessions Judge, Gajpati at Paralakhemundi, by order dated
12.04.2021 in the aforementioned case, the present BLAPL has been filed.

It is stated that after the expiry of interim bail period the petitioner has surrendered on 24.06.2022.

Perused the 164 Cr.P.C. statement of the victim. 7.
Considering the tenor of the same and taking into account the petitioner is in custody since 15.01.2021 and charge sheet has already been filed in the meanwhile, this Court directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin of the matter.

The BLAPL is accordingly disposed of.
