This matter is taken up through hybrid mode.

The Petitioner in this CMP seeks for a direction to learned Civil Judge (Junior Division), Berhampur for early disposal of C.S. No.160 of 2013 (2790 of 2014). 3.

Mr. Das, learned counsel for the Petitioner submits that the Petitioner is the sole Defendant in the aforesaid suit and has already filed her written statement since 14th May, 2014. Due to non-cooperation of the Plaintiff, the suit is being adjourned to different dates. He further submits that due to intervention of outbreak COVID-19 and its resurgence, the proceeding of the suit is also affected. At present, there is no legal impediment to proceed with the adjudication of the suit. Hence, he prays for the aforesaid relief.

Taking into consideration the submission made by Mr. Das, learned counsel for the Petitioner and on perusal of the record, the status of the suit is not clear. However, learned counsel for the Petitioner submits that the sole Defendant has

// 2 // already filed her written statement since 2014 and the suit has not proceeded further.

In that view of the matter, this CMP is disposed of with a direction to learned Civil Judge (Junior Division), Berhampur to make an endeavour for early disposal of C.S. No.160 of 2013 in accordance with law, if there is no legal impediment. 6.

Learned counsel for the parties are also directed to cooperate with learned trial Court for early disposal of C.S. No.160 of 2013.

Urgent certified copy of this order be granted on proper application.
