This matter is taken up through hybrid mode.

2.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in S.T. Case No.35 of 2021, on the files of learned Sessions Judge, Sonepur, arising out of Tarva P.S. Case No.200 of 2020 under Sections 147/148/452/341/302/149 of IPC.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Sessions Judge of Sonepur, by order dated 22.04.2021 in the aforementioned case, the present BLAPL has been filed.

Considered the recitals in the Case Diary and the statement of the wife of the deceased Draupadi Jal.

The materials on record including the medical examination of the petitioner indicate the minimal functionality of right hand.

7.

Considering the generality of allegations by none other than the wife of the Deceased who is an eye witnesses and keeping in view the functional disability of the petitioner, this Court directs petitioner to be released on bail on such terms to be fixed by the Court in seisin over the matter.

8.

Accordingly, the BLAPL stands disposed of.
