This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in C.T. Case No.50 of 2020, on the files of learned Additional District and Sessions Judge Boudh, arising out of Manamunda P.S. Case No.30 of 2020 under Sections 302/201 of IPC and is in custody since 28.02.2020. 4.
Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional District and Sessions Judge Boudh, by order dated 17.05.2021 in the aforementioned case, the present BLAPL has been filed.

Perused the statement of the accused-petitioner recorded under Section 27 of the Evidence Act and also the statement of the witnesses namely Kansari Naik and others.

Taking into account the genesis of the offences and the period of custody, this Court directs petitioner to be released on bail
on such terms to be fixed by the Court in seisin over the matter so as to ensure his presence on each date of trial. 7.
Accordingly, the BLAPL stands disposed of.
