Heard Mr.S.K.Nayak, learned counsel for the petitioner and Mr.D.Nayak, learned Additional Government Advocate.

According to learned counsel for the petitioner, the petitioner is aggrieved by non-execution of Non-bailable Warrant of Arrest passed against the opposite party No.4 in connection with Execution No. 150 of 2017 pending before the learned S.D.J.M.(Sadar), Cuttack.

In course of hearing Mr.Nayak submits that liberty may be granted to the petitioner to approach the learned S.D.J.M.(Sadar), Cuttack under Sections 82 and 83 of the Cr.P.C.

Considering the submissions made and without expressing any opinion on the merits of the case, this Court grants liberty to the petitioner to move application before the learned S.D.J.M.(Sadar), Cuttack under the appropriate
// 2 // provisions of the Cr.P.C. within a period of two weeks from today. In the event, such application is filed, the learned S.D.J.M.(Sadar), Cuttack is directed to proceed in accordance with law, if there is no other impediment. 5.
Accordingly, the CRLMP is disposed of.

Urgent certified copy of the order be granted on proper application.
