This matter is taken up by virtual/physical mode. 1.

The Petitioner is a principal borrower in two loan accounts, which have been classified as NPA on account of non-payment of instalments/non-servicing of the accounts. The prayer made in the present Petition is for directing the Bank to return title/sale deed bearing R.S.D. No.1659, dated 12th September, 2012 of the mortgaged property by receiving the outstanding aggregate amount of around Rs.5.50 lakhs.

Upon notice of the writ petition, counsel for the Bank on the previous date of hearing on 15th September, 2022 submitted that as of then, a sum of around Rs.6.88 lakhs in both the accounts was outstanding. The Petitioner is required to pay the said amount for raising the plea of the return of the title deeds of the mortgaged properties in both the accounts.

On the resumed hearing today, counsel for the Petitioner submitted that he has no instruction to appear in this matter, even otherwise we find that the Petitioner does not need any direction from this Court to pursue the relief claim for in the present writ petition.

The Petitioner is free to approach the bank and get the title deeds returned, if there is no other legal impediment by payment of the outstanding liability.
