This matter is taken up through hybrid mode.

This application under Section 482 of Cr.P.C. has been filed by the Petitioner with a prayer to quash the order of cognizance dated 17th June, 2010 passed by the learned Special Judge, Vigilance, Cuttack in T.R. No.13 of 2010 as well as the entire proceeding.

No one appears on behalf of the Opposite Party. 4.

Learned counsel for the Petitioner submits that he has no instruction in the matter from his client. 5.

Considering the submission of the learned counsel for the Petitioner and the fact that the case is the year 2011 where no interim order was passed, this Court is of the view that the Petitioner is a recalcitrant litigant and does not want to proceed with the matter.
