Heard the learned counsel for the Petitioner and the learned counsel for the State.

This application under Section 482 of Cr.P.C. has been filed by the Petitioner with a prayer to waive out the condition No.1 imposed vide order dated 7th April, 2022 passed by the learned Additional Sessions Judge, Padampur in Criminal Revision No.2 of 2022, which relates to furnishing of bank guarantee worth of Rs.3,00,000/- with one surety bond for the like amount.

It appears that the learned Additional Sessions Judge, Padampur, while directing to release the vehicle (MARUTI
// 2 // DZIRE VDI bearing No.OD-15P-2318) of the Petitioner, has imposed certain conditions where one of the condition is that furnishing a Bank Guarantee of Rs.3,00,000/-. Now, the Petitioner came to waive out of the aforesaid condition. 5.
Considering the submissions made and after going through the materials available on record so also considering the fact that the condition imposed is to ensure the production of vehicle before the court below as and when required by the court, the Criminal Misc. Case is allowed with a direction to the learned Additional Sessions Judge, Padampur to release the vehicle of the Petitioner without insisting the Bank Guarantee as imposed by the learned Additional Sessions Judge, Padampur but subject to the Petitioner executing of an indemnity bond of Rs.3,00,000/- supported by the property security and fulfillment of other conditions imposed by the learned Additional Sessions Judge, Padampur vide the aforesaid order.
