1. This matter is taken up through Hybrid mode. Order No.

2. Heard learned counsel for the Petitioner and the learned counsel for the State.

3. This application under Section 482 of Cr.P.C. has been filed by the Petitioner with a prayer to quash the order dated 16.12.2017 passed by the learned 1st Addl. Sessions Judgecum-Special Judge (POCSO), Balangir in Special G.R. Case No.752 of 2014 issuing N.B.W.(A) against him.

4. The accused-petitioner is absconding since 2017. The Spl. G.R is of the year 2014 and no justifiable reasons are there to quash the N.B.W.(A) issued against him.

Considering the aforesaid facts and submissions made, I am not inclined to quash the impugned order. However, if the

// 2 // Petitioner surrenders before the Court in seisin over the matter within four weeks hence and moves for bail, the Court in seisin over the matter shall consider his prayer for bail sympathetically. Till then the N.B.W(A) issued against the Petitioner shall not be executed.

6. With the aforesaid order, this CRLMC stands disposed of.

7. Urgent certified copy of this order be granted on proper application.
