This matter is taken up through Hybrid Mode.

The petitioner is accused in connection with C.T. Case No. 450(D) of 2013 corresponding to Komna P.S. Case No. 156 of 2013, pending on the file of the learned G.N.A-cum-J.M.F.C., Komna for the alleged commission of offence under Sections457/395 of IPC and r/w. Sectuion-25/27 of the Arms Act and are in custody since 02.04.2021.

Being aggrieved by the rejection of their application for bail U/s. 439 Cr.P.C. by the learned District & Sessions Judge, Nuapada in BLAPL No. 79 of 2021 by Order dtd. 17.05.2021, the present BLAPL has been filed.

Heard Mr. B.K. Panda, learned counsel for the petitioner and Mr. K.K. Gaya, learned Additional Standing Counsel for the State.

Learned counsel for the petitioner states that the basis of his implication is co-accused statement and that incident being of the
year 2013, he has been roped in only because there is one criminal case of similar nature.

Taking into account the period of custody and manner in which the petitioner has been implicated in the case at hand, it is directed that, the petitioner shall be released on bail on such terms to be fixed by the learned Court in seisin of the matter, with the additional stipulation that the petitioner shall appear in person once every week before the jurisdiction Police Station, the first date of such appearance to be fixed by the learned Court below. 7.
It shall be open for the learned Court below to cancel the bail granted, if there is any violation as stipulated.. 8.
The Bail Application thus stands disposed of. 9.
