This matter is taken up through Hybrid Mode.

The petitioner is an accused in connection with G.R. Case No.110 of 2021 corresponding to Birmaharajpur P.S. Case No.52 of 2021, pending on the file of the learned S.D.J.M., Birmaharajpur for the alleged commission of offence under Sections-395/120-B of the IPC, read with Section-25/27 of Arms Act, and the petitioner is in custody since 18.08.2021. 3.

Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C. by the learned Sessions Judge, Sonepur by Order dtd. 29.04.2021 in BLAPL No. 87 of 2021, the present BLAPL has been filed.

Heard learned counsel for the petitioner and learned Counsel for the State.

Taking into account that there is no recovery from the petitioner and that he has no criminal proclivity as stated by the learned counsel for the petitioner and the role ascribed to the petitioner by the prosecution, this Court directs the petitioner to be released on bail on such terms and conditions to be fixed by the learned Court in seisin over the matter.

The Bail Application thus stands disposed of. 7.
