This matter is taken up through hybrid arrangement (virtual/physical mode).

Heard learned counsel for the Petitioners and learned counsel for the State.

It is submitted on behalf of the Petitioners that the Petitioners are accused persons in C.T. Case No.151 of 2021, arising out of Mathili P.S. Case No.112 of 2021, pending in the court of Chief Judicial Magistrate-cum-A.S.J., Malkanagiri, for commission of alleged offence under Section 395 of I.P.C. It is submitted that accused are on court bail and only on 22.04.2022 since they remained absent and step was not taken on their behalf by the concerned Advocate, NBW/A of arrest was issued against the Petitioners. The said order is under challenged before this Court.

It is also submitted that due to communication gap, the Petitioners could not attend the court.

Considering the submission, it is directed that the order dated 22.04.2022, passed by the CJM-cum-ASJ, Malkangiri for issuance of NBW/A against the Petitioners is set aside subject to cash security of Rs.3,000/- (Rupees Three thousand) each. Petitioners are given liberty to surrender before the aforesaid court in C.T. Case No.151 of 2021 within a period fortnight hence, which shall be dealt with in accordance with law.

The CRLMC is accordingly disposed of.
