Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 08.03.2022 in connection with Colliery P.S. Case No.93 of 2022 corresponding to G.R. Case No.491 of 2022 pending in the Court of learned S.D.J.M., Talcher for the alleged commission of offence under Section 394 of IPC.

It is alleged that the petitioner along with two other persons obstructed the vehicle of the informant (Eicher Truck) and demanded money from the driver and Helper. When they refused, the accused persons assaulted them and forcibly took away the vehicle from the spot.

It is submitted that no one has been named in the FIR and the petitioner has been arrested only on suspicion. It is further submitted that that charge sheet has been submitted and as per the seizure list, the truck in question has been recovered. 6.
Considering the above facts, the period of detention in custody, the fact of recovery of the stolen truck as also the fact
that charge sheet has been submitted, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the Court in seisin over the matter on each date of posting of the case without fail. Further he shall appear before the IIC of Colliery Police Station on every Monday at 10 a.m. for a period of six months and such fact shall be certified by the IIC to the concerned Court once in every month.

BLAPL is accordingly disposed of.
