Heard learned counsel for the petitioner and learned counsel for the State.

This I.A. has been filed for modification.

Perused the recitals in the I.A.

It is submitted that in spite of the order dated 03.08.2022 which stood modified by order dated 30.09.2022 in I.A. No.1535 of 2022 the petitioner is still in custody.

It is submitted that as the immediate family members of the petitioner are not able to act as sureties, the petitioner is still languishing in custody.

Considering the hardship, the condition relating to sureties being immediate family members of the petitioner stands modified and it shall be open to the learned Court in seisin to release the petitioner on tendering of local sureties.

The order accordingly stands modified. The learned Court is requested to act on production of the order dated 03.08.2022 in BLAPL No.5255 of 2022 and order dated 30.09.2022 in I.A. No.1535 of 2022 along with the present order.

Other conditions shall remain unaltered.

Accordingly, the I.A. stands disposed of.
