1. This matter is taken up through hybrid mode. Order No.

2. Heard learned counsel for the Petitioner and learned Addl. Standing Counsel for the State.

3. The Petitioner is in custody since 12th July, 2021 in connection with Kantamal P.S. Case No.88/2021 corresponding to Special Case (NDPS) No.29/2021 pending in the court of learned District and Sessions Judge-cum-Special Judge, Boudh for the alleged commission of the offence under Section 20(b)(ii)(C) of N.D.P.S. Act.

4. It is alleged that the Petitioner and another person were transporting contraband ganja weighing 77 kgs. 500 grams in a TATA Indigo Car when they were apprehended by the Police. It is submitted that the co-accused namely, Umesh Ch. Kanhar, standing on the same footing has been released on bail as per the order passed by this Court in BLAPL No.9093 of 2021.

5. Considering the submissions made, the materials on record, the period of detention of the Petitioner in custody without commencement of trial, I am inclined to allow the prayer for bail.

6. Let the Petitioner be released on bail on such terms and conditions as may be imposed by the court in seisin over the matter in the aforesaid case including the condition that he shall appear before the court below on each date of posting of the case without fail. Further, the Petitioner shall appear before the I.I.C., Kantamal P.S. on every fortnight till conclusion of trial.

7. The BLAPL is disposed of.

8. Urgent certified copy of this order be granted on proper application.
