This matter is taken up through hybrid mode.

The Petitioner in this writ petition prays for a direction for early disposal of Settlement Appeal No.08 of 2017 stated to be pending before the Additional Sub-Collector, Bhubaneswar. 3.

Mr. Ray, learned counsel for the Petitioner submits that the Petitioner is Ex-army personnel and is aged about 82 years. Although Settlement Appeal filed in the year, 2017 is otherwise ready for hearing and there is no legal impediment for its disposal, the Additional Sub-Collector, Bhubaneswar is not taking any step in that regard for which the Petitioner is highly prejudiced. Hence, finding no other alternative, the Petitioner has filed this writ petition for the aforesaid relief.

Mr. Pani, learned Additional Standing Counsel submits that if the matter is otherwise ready for hearing, the Additional SubCollector, Bhubaneswar should take appropriate steps for early disposal of Settlement Appeal in accordance with law.

Taking into consideration the submissions made by learned counsel for the parties, this Court without expressing any opinion on the merits of Settlement Appeal No.08 of 2017 disposes of this writ petition with a direction that on production of certified copy of this order, the Additional Sub-Collector, Bhubaneswar-Opposite Party No.4 shall do well to take up and decide Settlement Appeal No.08 of 2017 stated to be pending before him as expeditiously as possible preferably within a period of three months therefrom, giving opportunity of hearing to the parties concerned, if there is no legal impediment.

Urgent certified copy of this order be granted on proper application.
